1. DEFINITIONS

1.3. E-Bidding application is a mobile application developed and operated by BETRIMEX to provide online bidding service under BETRIMEX trademark.

1.5. Users are providers who want to open and use the products or services of BETRIMEX.
1.6. Products / Services are services on the E-Bidding application.
1.7. API (Application Programming Interface) is an application programming interface.
1.8. OTP is a one-time password (One-Time Password).

2. SCOPE OF APPLICATION
This policy defines how BETRIMEX can collect, use, and secure information to the information are provided by users when opening or using E-Bidding accounts via E-Bidding application or the third parties using our API.

3. PURPOSE OF INFORMATION COLLECTION
User agrees that BETRIMEX has the right to collect, use, store, reveal and exchange user information, any information or transactions related to the user via E-Bidding account for the following purposes:
3.1. Delivery of Products / Services and Features: BETRIMEX uses the collected information to provide, personalize, maintain and improve our products or services.
3.2. Safety and security: BETRIMEX uses user's data to maintain the safety, security and integrity of our products or services. We may also collect and control transaction information from user devices and accounts to identify suspicious transaction behavior. In addition, BETRIMEX uses the full name, phone number, ID number that the user has provided to verify the information of the bank account which the user wants to link. This helps to ensure that the linked bank account matches the registered E-Bidding Account of the user, to avoid fraud, fraud or other law violations and to protect the safety and confidentiality for the user.
3.3. Customer Support: In case of the User contacts our Customer Support Department and after getting the User's consent, BETRIMEX uses the collected information including the audio recording of the support calls or customer care to:
3.3.1. Transfer the User's question to appropriate supporter
3.3.2. Investigate and resolve user queries and complaints
3.3.3. Follow and improve BETRIMEX's customer service
3.4. Research and development: BETRIMEX may use the collected information for research, analysis and development purposes to: (i) improve and enhance safety and security for BETRIMEX Products / Services; (ii) develop new features and Products / Services; (iii) support payment and financial solutions related to BETRIMEX Products / Services.
3.5. Exchanges from BETRIMEX: BETRIMEX may use the collected information to promote to Users about Products / Services, promotions, research, surveys, news, updates, events, contests with prizes, relevant awards, advertisements
3.5.1. Send notification via the E-Bidding Application (notification) to the User's E-Bidding Account;
3.5.2. Send a text message (SMS) or make a call to the User's telephone number according to the BETRIMEX information collected from the User;
3.5.3. Send an email to the User's email address according to the BETRIMEX collected information;
3.5.4. Release announcement or contact information on  www.betrimex.com.vn.
3.6. Implement the procedures and legal requirements: BETRIMEX may use the collected information to:
3.6.1. Investigate or resolve complaints or disputes related to the use of BETRIMEX Products / Services from Users; or
3.6.2. Perform other activities as permitted by applicable law; or
3.6.3. Provide the competent state agencies or provide information as required by law.

4. CUSTOMER INFORMATION COLLECTED BY BETRIMEX
The information BETRIMEX needs to collect in order to comply with legal obligations. BETRIMEX will ask the User to provide BETRIMEX with information regarding the creation of an account using BETRIMEX Products / Services that BETRIMEX may reasonably request for the following purposes:
4.1. Assist BETRIMEX in complying with its obligations as prescribed by law;
4.2. Report to the competent state agencies as prescribed;
4.3. Evaluate whether the User has complied, is complying with and can continue to comply with all its obligations under the BETRIMEX Policy.

5. SCOPE OF USE OF INFORMATION
5.1. In addition to the purposes set forth in this Policy, BETRIMEX undertakes not to transfer, lease, disclose or share the User's information to any third party without the User's consent or in accordance with strictly according to law provisions or at the request of competent state agencies.
5.2. Purpose of sharing and disclosing information:
5.2.1. At User's request, including:
 Share Users' information with third party partners, businesses, contractors, agents with BETRIMEX to perform Products / Services at the User's request;
 For the purposes of this Article, third parties may be: (i) other applications or websites that integrate BETRIMEX API or services; (ii) or applications or websites with APIs or services that BETRIMEX integrates; (iii) or BETRIMEX's business partners providing special promotions, contests or services;

6. RIGHT TO ACCESS AND EDIT USERS 'INFORMATION

6.2. Stop receiving email marketing newsletters: Users may choose to stop receiving marketing emails from the E-Bidding Application by clicking on the "unsubscribe" link in the email. If the User chooses to stop receiving, BETRIMEX will still send the User non-marketing emails, such as the User's account security information and alert when the User's account is logged in on other equipment.
6.3. Stop receiving BETRIMEX notifications on the E-Bidding Application from the rights in the access device: Users may choose to stop receiving BETRIMEX notifications on the E-Bidding Application (notification) by customizing the rights in the device. be accessed in accordance with mobile platforms (iOS, Android, etc.).

7. SECURITY MEASURES FOR INFORMATION SECURITY
7.1. BETRIMEX commits and uses reasonable methods to ensure the safety and security of personal information collected to prevent acts of theft, access, alteration and destruction of unauthorized information;
7.2. BETRIMEX will implement various security measures to ensure the safety of the User's data on the BETRIMEX system. User data is stored in a secure network and can only be accessed by a limited number of BETRIMEX employees.
7.3. BETRIMEX will retain User data in accordance with applicable law. BETRIMEX will cancel or switch incognito mode as soon as it reasonably confirms that: (i) the purpose for which the collected data is no longer suitable for retaining data; or (ii) retention is no longer necessary for any legal or business purpose; or (iii) The User has no need to use the E-Bidding Account.
7.4. BETRIMEX also recommends that the User take measures to protect his E-Bidding Account by not providing, exchanging accounts and providing login or OTP password to any other third party. If a User shares a computer or mobile device with another User, the User should not choose to save the login information (e.g., user ID and password) on that shared device and log out. Log off from the User's E-Bidding Account and close the User browser window at the end of the session. BETRIMEX is not responsible for any loss or disclosure of User's information due to User's breach of this Terms.

8. OTHER PROVISIONS
8.1. BETRIMEX does not exercise or apply any rights or remedies that BETRIMEX has under this Policy or the law shall not be deemed to be a waiver or restriction of such rights or remedies, and BETRIMEX warrants reserves the right to exercise such right or measure at any time BETRIMEX deems appropriate.
8.2. In the event that any provision of this Policy is determined to be illegal or otherwise unenforceable, BETRIMEX will amend such provision, or (in its sole discretion) waive that provision. out of this Policy. If any provision of this Policy is found to be unlawful or unenforceable, such determination will not affect the remaining provisions of this Policy, and the remaining provisions will still have full validity.
8.3. The User acknowledges that BETRIMEX, in accordance with applicable laws and regulations or after receiving instructions from relevant government agencies, may be required to take actions that may violate the provisions of these Policies. In this regard, User agrees not to hold BETRIMEX liable.
8.4. Users may not assign their rights under this Policy without the prior written approval of BETRIMEX. BETRIMEX may assign its rights under these Policies without the user's prior written consent.
8.5. This Policy will be binding on heirs, personal and legal representatives, title successors and permitted assignees of property (if any). user's.
